It is actually 4-4 with Kennedy sometimes going over to the liberal side making it 5-3.

There shouldn't be any fighting to begin with.  I will not voluntarily compromise away my rights.

Very sad but Court Justice Antonin Scalia's works should stand the test of time, but the current administration will most definitely try to make a drastic stand.  Obama will likely try for one of the brotherhood as an appointee!  ???

It's all going to depend on whether the GOP majority in congress will have the balls to stop any appointee who is anti-2nd-amendment.  If they were all tea-partiers, there would be no problem, but there are unfortunately a lot of RINOs in congress.

For the last 7 years all you have heard from the GOP was we need to follow the Constitution.

Well it's the Senate's DUTY to follow the Constitution, if they fail Obama will act without them and be justified.

Just think, Kennedy was consented to by Democrats under Reagan in his last year and the longest confirmation was 125 days for  Judge Landis.

History and the Constitution is on Obama's side. (This is why I have been saying make a deal with Obama to expand gun rights in exchange for background checks, now we get nothing and will be in trouble)

I am sure the 1st one and maybe the 2nd one get borked.

The worst thing to happen is if Obama nominates a black or another women. Plus it dooms the GOPs claim to be constitutionalists.

The only voters that will approve of this tactic will be gun owners and the anti abortion crowd. But they already vote GOP now. Fighting a black or women will just activate the Democratic base and as we all know, when Democrats vote, Democrats win.

The Electoral College is not the GOPs friend.

The GOP cannot run around claiming they are for the Constitution and then wipe their hineys with it. It will bring indies to the Ds.

Lose lose all around for the GOP.
