Any thoughts on LegalShield along with their Gun Owner Supplement. I was talking with our long time insurance agent, and he asked  if I?d like to discuss the differences between my current USCCA coverage  and what he offers. It would run aprx $4.00 more per month from our agent, but sounds like it covers substantially more

Read ALL of the contract before signing up for any of these. Most of them have clauses that will leave you high and dry.

To be specific about the things you should be wary of in these policies:

1.  Do the pay legal expenses leading to and during the criminal defense phase? 

Many (most?) of these policies have fine print that says they will pay only AFTER it is proven there was no criminal wrong-doing, AKA after the trial.  If you have a couple hundred thousand around to cover your costs while defending your innocence they will re-reimburse you after you win your trial.  If you lose your trial, they aren't paying your defense costs.

2.  Do they pay civil court costs regardless of your criminal court outcomes? 

Similar to the above, most have a clause that invalidates the policy if there is any criminal wrongdoing.  This could include the very real possibility of a plea deal where you plead no-contest to avoid jail and legal costs.  This puts you in the likely position of having a very involved civil lawsuit, and no insurance to cover those costs.

3.  Do they differentiate the elements of your charges?

Many (most?) policies from an insurance company are carefully written to limit their financial exposure.  This includes fine print that gets them out of paying anything if you have actually committed a crime.  So, you could be acquitted of the major charges like murder or manslaughter, but still be convicted of a more minor crime like brandishing or even trespassing.  In many policies this would be enough to invalidate your policy.

4.  How do I know if a given policy is a good policy?

It's the thing we all know we should do, but almost no-one does:  Get some professional advice!  Find a criminal defense attorney in your area.  Pay for a couple hours of his time and review the policies you are considering with him.  Ask him for his opinion not only on the policies your are considering, but if he knows of any good options.  And finally find out what agreement you need with him so he is prepared to receive your call and come to your aid in the event the unthinkable happens.

Thanks, I?ve thought about several of these things, and have somewhat come to the conclusion that no matter how justified your actions were, and no matter how prepared you are, it will likely be a long and grueling nightmare. I?m confident carry insurance from any number of ?supposedly? good companies will do what they can to avoid paying out, but am sure some are better than others. You thoughts on securing a couple hours of council with a local, and accomplished attorney seem to be my best bet. The insurance is likely more of a ?I feel better being insured? thing than anything else.

I read on LegalShield's website that they allows you access to a lawyer for all gun-related matters. Does anyone know how appropriate such a policy can be? I don't intend to commit any crimes, obviously, but I witnessed a case where my neighbor received actual prison time for negligent gun handling. In my opinion, he could have avoided this with a good lawyer. That?s interesting, yes, my USCCA policy makes me feel a little better, as I do not have an attorney on retainer (likely the best way to go) but as with any of them, if it?s not a one hundred percent clean shoot, they will run the other direction while your trying to embrace your new neck tattoos 😀
