Just some food for thought....

How many gun owners do you know that have NEVER had a background check.  I only know one.  He lives in Montana and is seriously paranoid about black helicopters and what have you.

I have bought and sold my share of guns via the newspaper and private party sales.  But I have also bought plenty at gun stores.  In fact, I probably have averaged two background checks a year in the last 5 years.

That would be a good poll....Do you own guns? if yes, have you ever passed a background check.  If yes, was the last one within 1 year? 3 years?  5 years?

I bet it would illustrate that there is almost nobody buying guns without going through a background check.

I don't mind the back round checks that are in place, however the current administration is pushing for data bases that records these sales as a registration scheme.  Some back round checks are being delayed which has been said to generate a file of the possible sale.   Why are they targeting Lawful citizens?  they either want to tax you out of ownership or confiscate your guns.  Just remember this Government Gone Wild, it is all about control and / or gun confiscation as their agenda!  SORRY!

I have been signing petitions and contacting my Senators, Representatives and Governor...I Stand with the NRA trying to do my part to preserve our rights. ;D

Well since our states CHL exempts us from the call, but the state already did a background check.  I guess I fall under the I have but not in years.

DM1906

Background checks are ONLY enforceable upon those who don't need a background check....

QuoteU.S. Supreme Court's 1968 Haynes v. U.S. decision:

Haynes, a convicted felon, was convicted of unlawful possession of an unregistered short-barreled shotgun. He argued that for a convicted felon to register a gun was effectively an announcement to the government that he was breaking the law and that registration violated his Fifth Amendment protection against self-incrimination.

The court, by an 8 - 1 margin, agreed, concluding: "We hold that a proper claim of the constitutional privilege against self-incrimination provides a full defense to prosecutions either for failure to register a firearm, or for possession of an unregistered firearm."

(Summary from American Rifleman magazine, March 2000, page 20)

So, when these gun registration schemes are announced, be very aware that only lawful gun-owners are required to register their firearms. Unlawful owners are exempted from registration laws due to their constitutional protection against self-incrimination.

I don't think your state chl exempts you.   It just makes it enough easier since the state has prints that they don't charge you.  In my state they still make the call there just isn't a fee.

Pretty sure there is no opt out option for the states.

Since 1968 I have had my share. Many of you do not remember when you had to sign for pistol ammo or 22 if you were under 21.I was in the military and when I cam home could not buy 22 ammo. I have had so many backgroung checks it takes them about 5 minutrs max now but here is the problem. If I do not buy from a dealer or I sell it to someone I know. The new law will require you yo take it to a gun dealer have him log it to his book then your buyer will fill out the 4473 and if it passes the state background if your state has one, mine does then he can get the gun and both of you have paid for the process. The is nothing more than a lets get a list of who has guns. No criminal or person going to commit a mass shooting is worried about when or how he got the gun or guns but our politicians are so smart they have the answers for everything. Well if you do lets fix the budget. Hey I know how to fix it lets print 17 trullion dollars and we will be even.Goverment math !!!

In NY all new sales (now all sales period) have checks and that's what I have gond through for every purchase. I don't know any other way...

In my state you only have a background check when buying from a licensed dealer or out-of-state seller.  Until recently there was a large and well populated firearms section in the classifieds of the local paper.

I have both bought and sold there.  In fact, my most recent Glock 29 was via the paper.  Transaction completed in the parking lot of a convenience store.  Handed cash, got gun.

Except, less than 3 months before I had purchased a used Para P12 in a store, complete with background check.

The text of the bill is finally available.  I have been reading it.  But the "findings" (reason for the legislation) assert serious "deficits" with the current NCIS system.

I find that to be false.  I keep pretty well up on such stats, and know of very, very few cases where  a legitimately prohibited person bought a gun via a legal channel without a background check and then committed a crime with it.  I am sure it happens, but I would be shocked if it is more than 1/500th of a percent of gun sales.

I have had at least 20+ in the last year. No issues except waiting few days for handguns because they were really busy.

The background check is not the point here. what it is is the starting point. You have to get something to pass before you can get other things to pass. It will just get easier and easier for them to slip it into some bill you never heard of and then you will wake up and read about it the next morning. Welcome to the New World.

In Texas they don't make the call,  that was the main reason I went and got mine.   I have a few guys with my name in prison, one has the same birthday as well.   We still fill out the 4473, but that's it.  The store can still call if they want, I have never had one that did.

In TN even if you have a CHP they still run a check thru the Tennessee Bureau of Investigation every time you buy a gun from a dealer. Reason? They get 10.00 for they check they know they are going to approve. We have tried to get the lawmakers to exempt permit holders from the checks but why would they do that. Its just an extra tax on the lawful gun owners. So you pay to get the permit and you pay each time you buy a gun. I guess it could be worse. I could live in NY,CT,IL CA and some others but I would not live there so that will never be a problem on my list. And look how good the finances of those states are doing.
