Legal gun owner slammed to ground by 7 agents over $1,500 30 year old debt

"I say, 'What is this all about?'" Aker told The News. "They say, 'Shut up, you know what this is all about.' I don't have a clue."

When Aker continued to ask, they continued to say "you know what this is all about," he said.

Eventually he was told it was about a 30-year-old student loan.

"You could have sent me a letter. You could have called me," Aker said.

The U.S. Marshals said later in court that they had the firepower because Aker had a gun, but he disputes that.

"But you were already at my door," he said. "It was because they knew I was a registered gun owner.

How was he a registered gun owner in a state that has no gun registration laws?

Let me follow that on by saying this.

If accurate....

We should not cloud this abuse of power over a student loan that happens to be owed to Uncle Sam.  If Citibank used and armed security service to rough up people that were delinquent on a debt, they would be in serious trouble.  Just because the creditor is the federal government does not give them the authority to carry out this kind of raid.  If they somehow used information about him being a gun owner, that is a different concern.  The big/primary concern here is that they would treat any citizen this way over a debt.

sqlbullet, you are spot on. This is disgraceful and needs to stop. Marshals are NOT IRS agents. This is what happens when agents of the state cannot say no to immoral orders. And yes in this matter, it's criminal. They could garnish wages instead of strong arm tactics.

NY is worse, they add your permit to the automobile license database. So when you are pulled over they know if you have a license.

In Texas in order to carry concealed you need a license.

First thing might not be easy, but find out the names of the seven.  Then find their oath, and obtain their bonds.  About this time they will realize what is going on and the loan balance and associated court expenses will likely quickly disappear.  The find out who the supervisor is and bring him/her into the mix for not training and supervising his/her underlings.  Send a letter with a $1000 bill for each wrong doer, plus $5,000 for the loss of freedom during the whole thing.  That's $13k total.  Include the bonding company in the mailing.  Just see what happens.  See who responds.  Follow up in a week for those that fail to respond via registered mail.  My guess is you will get their attention quickly.

If they don't settle quickly, get a process server, sue the men, and request a jury trial. 

That crap won't play in front of a jury, and they know it!!!!

He must have had a warrant.  I was going to say I've never heard of someone being arrested for not paying a debt, but I guess I have.

Either way, I don't like it.  I don't like people not paying their debts either.

Reading this case further, the judge is ordering via the Marshals, to bring debtors in. This is causing more friction than is warranted. So the court is saying debtors are fugitives (contempt of court). However The I.R.S. enforcement division is not being utilized. they could go as far as actually seizing property, garnishment of wages, bank account seizure etc. Let's say the person is on gov't disability, that would seize till balance is paid. This business of raids is over the top. In addition, this debt is 32 yrs old. Now, NOW it's an issue. Boy if the gov't enforcement of criminal bankers went this far, we would see banker heads in jail. They cause more people to suffer than most could imagine. This also tells me desperation in the economic atmosphere today. There using goon squads. Also remember in the past there was debtor prisons.

He was arrested because a bench warrant was issued for contempt due to his failure to appear for previous summons.

Here is what is curious to me.  Generally such summons are delivered via certified mail with return receipt, or more commonly by an officer of the court.  When I was in college I served a number of summons, and there was never any doubt the person was served.  So either Mr. Aker is lying when he said he had received no previous notice, or the plaintiff's counsel has mis-represented the facts to the court to generate the bench warrant.

Of the two, I would bet Mr. Aker did receive notice, and that evidence of service was provided to the court.

Also, listening to his interview, he doesn't indicate, that I have heard, that he was slammed to the ground.  They did cuff him for transport, but that is SOP.  I think alot of this is sensationalist journalism blowing it out of proportion.

However, the government should get OUT of the student loan business.

But 4949shooter said in another thread that "State Troopers are just regular people like all of us. They aren't the KGB ..."

OK technically it wasn't the State Troopers, but they were government law enforcement.

My question is, where is the IRS enforcement on these matters instead of the Marshals service. If he's evading, they simply can go for assets to get his attention. Gun business for 1500.00 bucks, really. And yes, gov't should not be in the loan business. here is the prudent matter to get payment.

1. Tax Refunds Offset by gov't.
2. Paycheck garnished.
3. Federal benefits taken.
4. Getting sued.
