AR Pistol Brace Debacle

I suppose this could go in pistols too.  Not gonna condone putting it in rifles despite what the ATF has decided.

I wanna hear the thoughts of those who are willing to be known.  I get it if you just wanna whistle and pass this by.

I have two guns encumbered with braces and barrels less than 16":  A 5.56 and a 300 blackout.  Currently I am in the "wait and see" tribe.  If it sticks and I actually have to do something or passively become a potential felon, here are my current thoughts:

I will remove the shockwave blade from the 5.56 and put a compliant pistol buffer on the gun.  It was configured this way initially and shoots great in that configuration.  The brace was really more to help my kids shoot it when they were little, and they aren't little anymore.

Originally I had the same plan for the 300 blackout.  But the more I think about it, I think I might just form 1 that gun.  I have always kinda planned on getting suppressor for it to make full use of the subsonics I handload.  Might as well two stamp it if the second stamp is free.

Anyone else wanna weigh in?  Advice for me or thoughts about your own plans.  (Or rants about this regressive over-reach).

We will all have to see how this all shakes out in the long haul!  I don't have any braces as mine are all rifles as they came.

I am probably going to get beat to death...but here it goes. I am in no way, shape or form saying these firearms should be illegal. I've had one in the past, I sold it to someone who really wanted it and have considered another one. I am saying the NFA needs to be repealed.  And this is my opinion only.

In my opinion if people would have used the braces as designed this would not be an issues. But you can go to youtube and find hundreds if not thousands of videos of ar/ak pistols being shouldered. The definition of a pistol is "to be held with one hand". Once the pistol is shouldered, is it still a pistol? OR even resting you cheek on the brace. Same with forward grips. If you put a forward grip you have changed the design of the pistol to now be held with two hands. When I had my 300BO pistol, I shouldered it.

Again, in my opinion I think "AR Pistols" is a short barreled rifle. When I was on the SWAT team I was issued a SBR with a 10.5" barrel. Other than caliber the only difference was one had a magpul adjustable stock and the other had a brace. They were nearly the same length with the pistol being a touch shorter. But not much. Does that mean I think people should have to go through a lengthy application process, pay a fee, and register it. Hell no. If I want an Ar pistol or a SBR I should be able to get it through the normal process of acquiring any other firearm. Same with supressors. If I want one I should be able to get one without jumping a bunch of hurdles.

With that being said, I am considering getting an AR Pistol but this time 7.62x39 to match the rifle I may or may not have.

For the time being, the atf has still not submitted the "rule" to the national register.  So, that is why you are not hearing about lawsuits right and left and that is specifically why the house and senate have not started official proceedings.

With that said, the house and senate have already sent 3 letters to atf, telling them to stop going back to 2020 in regards to pistol braces.  More than 200 elected reps had already signed the various letters.

The atf is following bidens agenda, which is not going to bode well for them I'm afraid.  Their "rule" rewrites the definition of a rifle, and rewrites tax law.  None of which I think they are allowed to do.

I have read the entire 293 page "rule" and all the supporting documents the atf have released.  I could write a wall of text explaining why I don't think it's legal, and why I believe that the courts are going to chew this up like ribeye steak, but for the time being, as of this last hour, the rule has NOT been published in the national register.  Which means, it's not valid or active.  And until that point in time, nothing about braces has changed.

So, I would urge that you not do anything until after the fact.  And if anything, well towards the end of the 120 day mark to see how it shakes out.

I could go into how the other two previous amnesties were done.  But neither was from an agency writing law.  They were done after congress wrote law, passed it, and the president(s) signed them.

Again, this is different from those in major ways.

@Rooster, the atf even said it was ok to shoulder it because it didn't change the classification of it.  I could theoretically place a revolver up against my shoulder and fire it too, but that doesn't change it into a rifle due to how it's fired.  But, I see your point.  And another issue with how the new rule is written because they are going to determine what's legal based on what everyone else is doing.

Again, it doesn't matter to me how everyone else does anything.  What matters to me, is how I do something.  I won't be judged on what anyone else does.  If that's the case, this is going to be a much slippier slope than anyone could imagine.

Matches banned due to arsonists.

Guns banned due to criminals.

Cars banned because of drunk drivers.

You see where I'm going with this?

I don?t own any AR pistols so none of this applies to me, but if it did the last thing I would do is talk about it on the internet.

IMO there is some vary nefarious language in there designed to entrap Americans that own previously legal firearms. By willfully filing for a ?free? stamp there is a real possibility that you could be incriminating yourself. Also there is language in there regarding imports and how they are now considered illegal under US 922.

Do what you feel is best for your situation but my advice is to keep it to yourself and don?t discuss it openly on the internet.

Since the rule hasn?t been published to the register yet, my understand is it can still be amended. You can be assured that forums like this are being monitored.
