I'm in CA where carrying a handgun is generally illegal without a CCW which is generally impossible to get. No 2A in CA

my bad, im not a cop so im not completely familiar with punishments for different things.

Ive just always figured that there had to be a conflict between upholding the constitution and upholding local laws.

One time for example, i was minding my business, drinking some coffee and doing some school work on my laptop, when all of a sudden i heard a loud "HEY YOU!" i turn, and theres a cop with his gun drawn, and he tells me to go over to him. so i head on over and he asks if my gun is loaded, i tell him no (state law), and he comes over to me with a few more cops.

they take my gun and ensure its unloaded, then they search me even though i told them i was not doing anything illegal and that they had already verified that by checking my gun. the cop tells me hes going to search me anyway. i told them multiple times that i did not consent to a search of my person or my property, and that i would submit only to a check of my firearm to ensure that it was being carried legally. they didnt care and they terri searched me anyway.

then they asked for ID, i politely told them that i would not be providing them with any ID, so they took my weapon against my will, even after i told them that they werent allowed to, and they checked the serial number to find my name. they asked if the weapon was registered to me and i told them that i was not going to answer that question, and that i was of the impression that our encounter was over, and anything further would be an unlawful detainment, seeing that they had no reason to believe that i was in the commission of a crime.

It took a while, and my 4th and 2nd amendment were severely violated, but they let me go on my way.

so thats where i think that dilemma comes into play; were they upholding local laws in checking that my gun was unloaded? yes. did they violate my rights in doing so? yes.


i guess the way i see is that if youre a cop around here, you at the very least support unconstitutional laws by agreeing to uphold them.

i too took an oath to defend the constitution when i was in the military, which is part of the reason i get so upset when other people violate it, or support violating it. whether it be an anti gun nut, or a freedom hating government agent that doesnt want civilians to have guns.

Blue is good, and calming- helps keep conversations civil. Red themed forums always have crazy arguments and crap talking. I always made my forums blue themed for that reason primarily.

that seems like the toughest part about the job, especially having to site someone for doing something that should be legal.

like giving a ticket or arresting someone for a gun related offense. i mean, as a cop, if i pulled someone over that was carrying a loaded gun with out a permit or something along those lines, it would just suck to have to give them grief for doing something that is constitutionally legal, but illegal by some obscure law which was probably brought about on a racist pretense.


did you ever struggle morally between upholding law vs being true to the two oaths that you swore to that said you would uphold and defend the constitution?
